Fixtures and Fittings: What's included? The contract of sale is the document that you can rely on to tell you what you are buying and what is being left behind. As a rule, fixtures remain and everything else goes unless the contract states otherwise.
If the house contains a beautiful big chandelier with crystal drops sparkling in the entry hall don't just assume that it is going to stay. Often it will not be there when you arrive. A chandelier must be included if it is not specifically listed as being "not included in sale"! All fixtures are included in the sale unless specifically stated in the contract.
Fixtures are included: the stove, a dishwasher installed under the sink area, a microwave built into the wall, lighting throughout the home but not lampshades, air-conditioning systems, all door furniture, shower roses, window shades, blinds and curtains, pool maintenance equipment and covers are fixtures.
Fittings are not included: fridges, free standing microwaves, washing machines and dryers, outdoor furniture settings, garden ornaments and so on.
But how can you be certain that everything you thought you were buying as part of the sale remains in the place when it is vacated by the old owner?
Here's how to do it!
- Make a list of everything you believe to be part of the deal. You can do this by going through the house room by room and listing everything and agreeing what stays.
- If you buy at Auction all fixtures stay unless it is stated otherwise in the contract.
- Be prepared to negotiate with the present owner on items that may not necessary stay. Items such as side-boards that fit ideally into a space in the wall or a painting that sets the tone of a particular room. Indeed anything can be negotiated to stay with the house, and often is. Owners are quite often happy not to have to take heavy items with them as they cost a lot to move and may not fit into their new abode.
